eClub Member Program Terms & Conditions

Important: Please read these terms and conditions carefully.

The eClub Member Program is a Program offered by TFE Hotels. TFE Hotels website and all other TFE Hotels branded websites including those listed below in clause 1 (each a website) are owned and operated by Toga Hotel Management Holdings Pty Limited ACN 162 986 352, an Australian registered company with headquarters at Level 5, 45 Jones St, Ultimo NSW 2007, Australia. The Company owns and conducts business under the registered business name “TFE Hotels.”  

The Program and its benefits are offered at the sole discretion of TFE Hotels. TFE Hotels may assign or transfer any rights or obligations under this Program, at any time. 

About these terms 

These Terms and Conditions are for the eClub Member Program. Your participation in the Program will be governed by these Terms and Conditions and any applicable laws or regulations. It is a Member’s responsibility to read and understand them. We ask that you read them carefully. 

The general TFE Hotels Terms and Conditions can be found here. These TFE Hotels Terms and Conditions (including the Hotel Conditions of Sale) govern your use of any of our websites. By accessing any website, you agree to be bound by these TFE Hotels Terms and Conditions including the Hotel Conditions of Sale, where relevant. 

When these terms apply to you 

These Terms and Conditions apply to you if you are a Member of the Program. 

Changes in The Program Terms & Conditions and Program Rights: 

TFE Hotels reserves the right to modify, alter, or otherwise update the Membership Terms and Conditions for the Program, and to modify, suspend, or cancel the Program at any time, including where required to do so by law. In the event of any such changes, appropriate consideration will be given to the interests of the member.  Where the change is significant, we will provide you with prior notice. You will have the opportunity to object within fourteen (14) days. Insofar as the Membership continues without objection after the enactment of changes, this signifies the Member’s consent to the new Terms & Conditions. If a Member objects to the change within the allotted time period, their Membership can be cancelled by the user in accordance with item 5.1.3. 

The “last updated” date set forth at the end of these Terms and Conditions indicates when changes have been made, and it is a Member’s responsibility to review changes to the Terms and Conditions regularly. By continuing your Membership in the Program after the date on which changes are made to the Terms and Conditions, you are agreeing to those changes and affirming your agreement to comply with all the Terms and Conditions, as updated. The current Program Membership Terms and Conditions supersede all prior published Program Membership Terms and Conditions. 

1. Definitions

In these Terms and Conditions: 

"We", "our", "us" and "TFE Hotels" means the Company and where the context requires or permits includes its related bodies corporate (as defined in the Corporations Act 2001 (Cth)). 

"You" and "your" means eClub Member Program member(s). 

“Company” means Toga Hotel Management Holdings Pty Limited ACN 162 986 352, 

“Program Participating Hotel” means a hotel who participates in the eClub Member Program. which operates under any of the following brands:   A by Adina, Adina Hotels in Australia/New-Zealand and Europe, Vibe Hotels in Australia, Travelodge Hotels in Australia and New Zealand, Rendezvous Hotels in Australia, Hotel Kurrajong Canberra, Savoy on Little Collins Melbourne, and Quincy Hotel Melbourne. 

“Program” means the eClub Member Program 

“Terms and Conditions” means eClub Member Program Terms and Conditions 

“Hotel Room Night” and “Hotel Stay”: A Hotel Room Night means each individual night of a stay at any Program Participating Hotel. A ‘Hotel Stay’ means all consecutive nights that a member stays at a Program Participating Hotel even if they have checked out and checked back in for consecutive nights. For example: ( i) if a guest stays for five consecutive nights this will be recorded as one ‘Hotel Stay’ and five ‘Hotel Room Nights’; ( ii) if a guest stays for one night only, this will be counted as both one ‘Hotel Stay’ – and one ‘Hotel Room Night’; and (iii) if a guest stays for one night, then checks out, then checks back in to stay for the subsequent night and then checks out this will be recorded as one ‘Hotel Stay’ – and two ‘Hotel Room Nights’. 

“Member” means an individual that has been approved by the Program Operator to be an Individual Member in the Program. 

“Membership” means membership of the Program by a Member. 

“Member Rate” means a special hotel nightly room rate that is only available to individual members when they book direct on TFE Hotels website or any TFE Hotels branded websites at any Program Participating Hotel. 

“Program Benefits” means benefits and rewards that are made available to a Member in the Program as set out in Clause 4. 

“Program Operator” means Toga Hotel Management Holdings Pty Limited ACN 162 986 352. 

“Program Partner” means any Program Participating Hotel or other entity specified by the Program Operator who has agreed to participate as a Program Partner in the Program to offer Benefits to Members from time to time. 

“Qualifying Rate” means the rate for individual Members where the booking has been made as set out in Clause 4.2.1 and the Hotel Stay is subsequently completed and paid for in full. Certain group bookings and other special promotional rates may not be a Qualifying Rate. The person making any booking should check at the time if the rate they are booking is a Qualifying Rate and/or if that booking will be eligible for any or all Member benefits. 

“Qualifying Stay” means a Hotel Stay which meets the criteria set out in these Terms and Conditions 

“Terms and Conditions” mean these terms and conditions which apply to Members of the Program. 

2. Program Partners

The Program Partners (including the list of The Program Participating Hotels) may vary from time to time. Members should check the below section for the current listing of Program Partners. 

TFE Hotels hotel brands currently participating in the Program include the following:   

  • Adina Hotels in Australia, New Zealand, Austria, Germany, Switzerland and Denmark 
  • Vibe Hotels in Australia
  • Travelodge Hotels in Australia and New Zealand
  • Rendezvous Hotels in Australia
  • Quincy Hotel Melbourne
  • A by Adina
  • Hotel Kurrajong Canberra
  • The Savoy Hotel on Little Collins 

Hotel brands that are part of the TFE Collection participating in the Program may be added or removed at TFE Hotels discretion. 

3. Membership

3.1 General Criteria 

Membership is for a person and provides that this person will receive certain benefits as set out in these Terms and Conditions. 

  1. The Program Operator has approved the individual’s Membership application at its sole discretion; 
  2. The individual must be 18 years of age or older; and 
  3. The individual must provide and maintain details of a valid and unique email address for their Membership at the time of joining and for their period of Membership. 

3.2 Types of Memberships 

Membership may be held by an individual. 

3.3 Cost 

The eClub Member Program is free to join. 

3.4 Marketing & Communications 

By agreeing to the Terms and Conditions, individuals agree to receive exclusive offers and program information via email, SMS or WhatsApp communication. Members may elect not to receive promotional communication by using the unsubscribe functionality within the communication received, or by contacting the eClub Member Team at [email protected]

3.5 Eligibility 

By participating in the Program and taking advantage of its benefits, you agree to the following: 

  1. To maintain and use only one eClub Member Program account at any time. 
  2. To be the only individual using your Member account (i.e., not sharing your account with anyone unless expressly permitted by TFE Hotels). 
  3. That you have provided current and valid contact information. 
  4. That your name as shown on your member login matches your legal identification. 
  5. That you only have one email address for your member account. 
  6. That you are at least 18 years of age or the age of majority in your state or province of residence, whichever is older. 
  7. That you have not enrolled as a company and/or other entity, as only individuals are permitted to enroll in the Program. 
  8. That you have read and understand these Terms and Conditions. 

3.6 Member Enrollment: 

There is no fee to join the eClub Member Program. New members may enroll in the Program by completing the required information on the Program website, or through TFE Hotels branded websites, or other channels authorised by TFE Hotels. By enrolling in the Program and using your membership account, you will be eligible for benefits as described below. 

There are two ways a Member can enroll to eClub Member Program: 

  • At time of booking when selecting ‘Member Rate” via any of the Program Participating Hotels websites; or   
  • Via any of the Program Participating Hotels websites sign up pages 

During the eClub Member enrollment process, the member will be asked to provide: 

  • First name 
  • Last name 
  • Email address 
  • Country  
  • Language preference 
  • Agree to these Terms and Conditions and TFE Hotels group Privacy Policy. Agree to receiving eClub news and special offers (Member can opt-out at any time). 

3.7 Activation of enrolment 

Following the successful completion of the enrolment as outlined in 3.6, the Member will be required to set up a password associated with the membership.  A welcome email will be sent by [email protected] to the member email address registered to complete the enrolment.  

3.8 Member Contact Information:  

Program Members are responsible for keeping their profile information current, including relevant information such as email address. Each Program Member is responsible for restricting access to and maintaining the confidentiality of the Member’s account and password and agrees to accept responsibility for the activities of anyone using the Member’s password. When contacting the eClub Member Team about your account, you may be asked for additional information for fraud prevention and security purposes. 

TFE Hotels has the right to terminate a Member’s account and/or revoke any Member Benefit if an account has multiple email addresses and/or is suspected of being related to fraudulent or abusive activity. 

3.9 Data Protection:  

3.9.1 Use of Information 

You consent and authorise TFE Hotels and the relevant Program Participating Hotels to collect, use and disclose your personal information for the purpose of administering your Membership and providing you with services associated with your Membership.  

Moreover, you will be asked for an additional consent to receive newsletters so that we can keep you up to date with promotions, updates and member benefits. For this purpose, we will process the personal data that you have provided to us during the registration process. 

Your eClub Member Program consent is separate to the consent for the TFE hotels general T&Cs. We process your personal information in accordance with the TFE Privacy Policy.

You have the right to withdraw your consent at any time by clicking on the "unsubscribe" button in the marketing email or by sending an email to [email protected].

If you withdraw your consent, we may terminate your membership of the eClub membership program.

3.10 Term of Membership 

The term of Membership commences from the date of enrolment to The Program until either: 

  1. Termination of Membership by the Member; or 
  2. Termination of Membership by the Program Operator.

4. Program Benefits

As a Member of the eClub Member Program, you have access to special services and benefits at any of the Program Participating Hotels. Benefits and services may change from time to time and may vary by hotel, country, and geographical region. eClub Member Program benefits are only available to Members who book hotel reservations through TFE Hotels website or any other TFE Hotels branded websites.  

This section sets out the Program Benefits that are available to Members on the Program Participating Hotels as defined above. 

4.1 General

4.1.1 The Program Operator does not guarantee or warrant that any or all of the Program Benefits will be available at all times. The Program Operator reserves the right to change, modify, limit or cancel any of the Program Benefits at any time based on availability. This includes increasing or decreasing any requirements or eligibility to receive a Program Benefit, changing the value of rewards or limiting the availability of rewards.  

4.1.2 The full range of Member Benefits will only be available if the Member makes their reservation at a Program Participating Hotel using one of the following methods: (i) Direct online at www.tfehotels.com;  or (ii) Direct online at any TFE Hotels branded websites. 

4.2 Membership Program Benefits 

4.2.1 The following Program Benefits apply to Members and on stays at Program Participating Hotels 

1. eClub Member Rates 

Members will enjoy exclusive eClub Member Rates available to be booked direct on the TFE Hotels website or any TFE Hotels branded websites.  eClub Member Rates are available for hotel stays up to fourteen consecutive nights.

2. Instant Rewards   

Instant Rewards are defined as complimentary benefits offered to members at the time of booking.  

Instant rewards are available only when the eClub Member Rate is selected and will subsequently be made available during the booking process. 

Instant rewards are at the discretion of the hotel and availability will vary dependent on, but not limited to season, day of week, availability of stock. 

Instant rewards do not accrue to be used for future stays. 

3. Exclusive Member Deals     

Exclusive Member Deals, special offers and early access to sales events may be offered from time to time at the discretion of the operator and will be made available for booking via https://www.tfehotels.com/en/eclub-member-offers/ 

5. Termination and Liability

5.1 Termination 

5.1.1 TFE Hotels’ right to terminate the membership, reverse or cancel Program Benefits 

If in the Program Operator’s reasonable opinion, a Member is using their Membership in an abusive or fraudulent way, has failed to comply with these Terms and Conditions, has committed any unlawful act, or causes willful damage to the Program Operator’s property (Member Violation), the Program Operator may at its election: 

  • immediately terminate the Membership; 
  • suspend a Membership temporarily until further notice; and/or 
  1. reverse or cancel any Program Benefits that a member has accrued. 

Examples of a Member Violation include, but are not limited to the following: 

  1. Member’s violation of these Terms and Conditions. 
  2. Member’s misrepresentation of any information or any misuse of this Program. 
  3. Member’s violation of any national, regional, or local law or regulation in connection with the use of membership privileges. 
  4. Member’s commission of fraud or abuse involving any portion of this Program, including but not limited to any conduct that improperly impacts the accumulation of benefits or rewards, or abuses the redemption aspects of the Program.  
  5. Member maintaining more than one active account. 
  6. Member’s physical, verbal, or written abuse or harassment of hotel team member.
  7. Member’s abuse/misuse of any benefits or privileges provided by TFE Hotels website or any TFE Hotels branded websites or use of such benefits or privileges in violation of the applicable terms and conditions for them, including but not limited to the sale or barter of eGift vouchers, discounted eClub Exclusive benefits or Instant Rewards. 
  8. Member booking a stay on a Member Rate and receiving benefits at more than one property on any given night. 
  9. Member taking any other action or engaging in any other activities that are to the detriment of the Program, TFE Hotels, or an TFE Hotels branded website; all as may be determined by TFE Hotels in its sole discretion. 

If a member account is duplicated or unauthorised activity is discovered, TFE Hotels may suspend the Membership until the account is secured by contacting the eClub member team at [email protected]. The Member may be required to create a new account or update their personal information for additional security. If a member is inactive for a period of five years, TFE Hotels reserves the right to permanently cancel the membership. 

TFE Hotels’ cancellation of a Membership is effective immediately, and in cases of inactivity or fraudulent activity, TFE Hotels may close, suspend, or cancel the account without notifying the Member. TFE Hotels will not be responsible for failure to notify any Member of cancellation of the Member’s account if the Member’s account did not contain valid contact information. In the event TFE Hotels cancels a Membership as permitted under these Terms and Conditions, TFE Hotels has no obligation to permit the individual whose membership was cancelled, to re-enroll in the Program. 

5.1.2 Termination on death of person who is Member 

Upon notification of the death of a member, the membership will automatically terminate. 

5.1.3 Termination by the Program Operator 

The Program Operator is entitled to terminate the Membership in the following circumstances:  

(a) the Program is no longer commercially viable; 

(b) there is a strategic change in direction for TFE Hotels; or 

(c) if required due to factors outside of TFE Hotel’s control. 

The Program Operator shall also have the right to terminate membership without cause upon two (2) weeks' notice. 

5.1.4 Consequences of termination 

All benefits, offers and rewards will be forfeited on termination of a Membership or termination of the Program. The Program Operator (and its related bodies corporate and Program Partners) will have no further liability to any Member on termination of the Member’s membership or on termination of the Program. 

6. Liability

  1. neither the Program Operator (and its related bodies corporate and Program Partners) nor you will be liable for any indirect or consequential loss or damage of any kind including loss of profits and loss of revenue in connection with the Program; and
  2. the maximum aggregate liability of the Program Operator (and its related bodies corporate and Program Partners) in connection with the Program, whether for breach of this Agreement or in tort (including negligence) or otherwise is AUD $10,000.

7. General

7.1 Governing law 

These terms and conditions of the Program are governed by the laws in force in New South Wales. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.  

If Members are consumers, the mandatory consumer protection laws of their home country shall apply irrespective of the choice of law. 

If Members are consumers residing in a country within the European Economic Area, Members may, at their option, bring claims either before the competent court of their place of residence or before the competent court of the Program Operator's registered office. 

Restricted by Law:  

This Program or participation in it is not valid, and/or the granting of rewards or benefits is void, where prohibited or restricted by law in the Member's home country (domicile) or locality. 

7.2 Tax liability 

Taxing authorities may determine that eClub Instant Rewards, Benefits, and airline Points received through participation may be subject to tax liability, including, without limitation, foreign, federal, state and local taxes, surcharges, security charges and departure taxes. In that case, any tax liability, including disclosure, connected with the receipt and/or use of rewards is the responsibility of the eClub Member. 

8. Right of Withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the date of conclusion of the contract. 

To exercise your right of cancellation, you must notify us of your decision to cancel the contract in a clear and unambiguous manner (e.g. by letter or email). For this, you can use our sample cancellation form to exercise your right of cancellation. However, this is not compulsory. In order to comply with the cancellation period, it is sufficient that you send your notice of cancellation before the end of the cancellation period. 

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
